Businesses sometimes get bogged down in situations where they could benefit from assistance with negotiations between parties. Two main factors need to be taken account of in such circumstances:

Sometimes, business owners use parties that are already connected either with themselves or else with the business. Examples of connected partis can include the following:-

Not all negotiators can work through the full commercial implications of a decision affecting the business. So a good know-how of business, and commercial matters can help the parties, especially if it is independent.
There are not many people that have knowledge of mergers and acquisitons, and such know-how can help in commercial negotiatons between shareholders. The extent to which solutions are possible depend on the circumsances in each particular case. A sound understanding of the drivers of value, and of arriving at consensus about commercial matters can be a great help.
Some parties are focussed particularly on the courts as a means of resolving disputes. Fees tend to be time-based and the legal processes tend to be bureaucratic and lengthy. This tends to keep the parties entrenched in opposite camps, with little encouragement for arriving at common ground or achievable solutons at lower cost.
